1. Who we are

kitatax.com (“KitaTax,” “we,” “us”) provides software that helps Philippine online sellers organise marketplace settlement data, track 1% creditable withholding tax, reconcile BIR Form 2307, generate EOPT-compliant invoices, and prepare quarterly filing worksheets. By creating an account or using the service you agree to these Terms.

2. Not tax, accounting, or legal advice

KitaTax is a self-serve software tool, not an accounting firm, tax agent, or law firm. Computed figures (e.g. 2551Q and 1701Q worksheets) are estimates to help you prepare your own filings in eBIRForms — they are not official BIR assessments and do not constitute professional advice. You are responsible for the accuracy and timeliness of your own BIR registrations, filings, and payments. Consult a CPA or tax professional for advice specific to your situation.

3. Eligibility & your account

You must be at least 18 and authorised to act for the business you register. You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate business details (e.g. TIN, RDO code) and keep them current.

4. Subscriptions, trials & billing

Plans are billed in Philippine Pesos through PayPal on an auto-renewing monthly or annual cycle. New accounts may start a 14-day free trial without a card; access to paid features ends if no active subscription is in place when the trial ends.

Subscriptions renew automatically until cancelled. You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current paid period. Except where required by law, payments already made are non-refundable. We may change prices with prior notice; changes apply from your next renewal.

5. Acceptable use

Do not misuse the service: no unlawful activity, no uploading data you have no right to use, no attempts to breach security or access other tenants’ data, no reverse engineering, and no reselling the service without our written consent.

6. Your data

You retain ownership of the data you upload. You grant us a limited licence to process it solely to provide the service. Our handling of personal data is described in our Privacy Policy.

7. Availability & disclaimers

We work to keep the service available but provide it “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that figures, reconciliations, or reminders are error-free or that the service will be uninterrupted.

8. Limitation of liability

To the fullest extent permitted by law, KitaTax is not liable for indirect, incidental, or consequential damages, or for any penalties, surcharges, or interest assessed by the BIR. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

9. Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms or non-payment. On the BIR’s 10-year record-retention basis we may retain certain records as described in the Privacy Policy.

10. Changes & governing law

We may update these Terms; material changes will be notified in-app or by email. Continued use after changes means acceptance. These Terms are governed by the laws of the Republic of the Philippines, with venue in the proper courts of the Philippines.
